Sec. 2033. Contingent funding increase

    If for any fiscal year the amount appropriated directly to the 
Secretary of Defense for the National Guard Challenge Program under 
section 509 of title 32 is in excess of $62,500,000, the Secretary of 
Defense shall (notwithstanding any other provision of law) make the 
amount in excess of $62,500,000 available for the Junior Reserve 
Officers' Training Corps program under section 2031 of this title, and 
such excess amount may not be used for any other purpose.

                               Amendments

    2000--Pub. L. 106-398 substituted ``appropriated directly to the 
Secretary of Defense for'' for ``appropriated for''.


                             Effective Date

    Pub. L. 106-65, div. A, title V, Sec. 547(b), Oct. 5, 1999, 113 
Stat. 609, provided that: ``Section 2033 of title 10, United States 
Code, as added by subsection (a), shall apply only with respect to funds 
appropriated for fiscal years after fiscal year 1999.''
