Sec. 4411. Establishment: purpose

    The Secretary of the Army may maintain schools and camps for the 
military instruction and training of persons selected, upon their 
application, from warrant officers and enlisted members of the Army and 
civilians, to qualify them for appointment as reserve officers, or 
enlistment as reserve noncommissioned officers, for service in the Army 
Reserve.

 Authorization for Instruction of Civilian Students at Foreign Language 
                  Center of Defense Language Institute

    Pub. L. 103-337, div. A, title V, Sec. 559, Oct. 5, 1994, 108 Stat. 
2776, as amended by Pub. L. 104-201, div. A, title III, Sec. 371, Sept. 
23, 1996, 110 Stat. 2499; Pub. L. 105-85, div. A, title X, 
Sec. 1073(c)(3), Nov. 18, 1997, 111 Stat. 1904, provided that:
    ``(a) Admission of Civilians as Students.--(1) The Secretary of the 
Army may enter into an agreement with an accredited institution of 
higher education (or a consortium of such institutions) under which 
students enrolled at an institution of higher education that is a party 
to the agreement may receive instruction at the Foreign Language Center 
of the Defense Language Institute on a space-available basis.
    ``(2) The Secretary may also permit other persons who would benefit 
from the instruction provided at the Center, as determined by the 
Secretary, to receive instruction at the Center on a cost-reimbursable, 
space-available basis.
    ``(b) Selection and Attendance.--(1) The Secretary shall select the 
persons who will be permitted to receive instruction at the Center 
pursuant to subsection (a). In the case of agreements under subsection 
(a)(1), the Secretary shall consult with the other parties to the 
agreements to establish qualifications and methods of selection for 
persons to receive instruction at the Center.
    ``(2) Except as the Secretary determines necessary, a person who 
receives instruction at the Center pursuant to subsection (a) shall be 
subject to the same regulations governing attendance, discipline, 
discharge, and dismissal as apply to other persons attending the Center.
    ``(c) Reimbursement Options for Certain Instruction.--In the case of 
instruction provided to students described in subsection (a)(1), the 
Secretary may provide the instruction on a cost-reimbursable basis, a 
reimbursement-in-kind basis, or a combination of both options. 
Regardless of the reimbursement option, the value of the reimbursement 
received under this subsection may not be less than the amount charged 
for providing language instruction to Federal employees who are not 
Department of Defense employees. The Secretary may not delegate the 
authority to accept an offer for in-kind reimbursement below the level 
of the Assistant Secretary of the Army.
    ``(d) Retention of Funds.--Amounts collected under subsection (a) or 
(c) to reimburse the Center for the costs of providing instruction to 
students under subsection (a) shall be credited to funds available for 
compensation of instructors at the Center and to defray direct civilian 
student costs to the school.
    ``(e) Center Defined.--For purposes of this section, the term 
`Center' means the Foreign Language Center of the Defense Language 
Institute.
    ``(f) Expiration of Authority.--No student may be admitted to the 
Center under subsection (a) to commence a program of instruction 
beginning after September 30, 1997.''
