Sec. 1070a-33. Eligibility of scholars


(a) Procedures established by regulation

    The Secretary shall establish by regulation procedures for the 
determination of eligibility of students for the scholarships awarded 
under this division. Such procedures shall include measures to prevent 
any secondary school from certifying more than 10 percent of the 
school's students for eligibility under this section.

(b) Coordination

    In prescribing procedures under subsection (a) of this section, the 
Secretary shall ensure that the determination of eligibility and the 
amount of the scholarship is determined in a timely and accurate manner 
consistent with the requirements of section 1089 of this title and the 
submission of the financial aid form required by section 1090 of this 
title. For such purposes, the Secretary may provide that, for the first 
academic year of a student's 2 academic years of eligibility under this 
division, class rank may be determined prior to graduation from 
secondary school, at such time and in such manner as the Secretary may 
specify in regulations prescribed under this division.
