Sec. 8923. Data and policy dissemination under IDEA

    The Secretary shall--
        (1) widely disseminate the policy of the Department in effect on 
    October 20, 1994, with respect to disciplining children with 
    disabilities;
        (2) collect data on the incidence of children with disabilities 
    (as such term is defined in section 602(a)(1) \1\ of the Individuals 
    With \2\ Disabilities Education Act) engaging in life threatening 
    behavior or bringing weapons to schools; and

        (3) submit a report to Congress not later than January 31, 1995, 
    analyzing the strengths and problems with the current approaches 
    regarding disciplining children with disabilities.

    Section 602 of the Individuals with Disabilities Education Act, 
referred to in par. (2), was classified to section 1401 of this title 
and was omitted in the general amendment of subchapter I of chapter 33 
of this title, by Pub. L. 105-17, title I, Sec. 101, June 4, 1997, 111 
Stat. 37. Pub. L. 105-17 enacted a new section 602 of the Act which is 
classified to section 1401 of this title, and which contains provisions 
defining ``child with a disability''.
