SUBCHAPTER II--CIVIL COMMITMENT OF PERSONS NOT CHARGED WITH ANY CRIMINAL 
                                 OFFENSE
 
Sec. 3422. Commitment to hospital of the Service dependent upon 
        certification of availability of facilities or personnel for 
        treatment
        
    Notwithstanding any other provision of this subchapter, no patient 
shall be committed to a hospital of the Service under this subchapter if 
the Surgeon General certifies that adequate facilities or personnel for 
treatment of such patient are unavailable.
