Using your definition of open there would be almost no open hardware design
chips. The designs that are currently being done by open cores and other
groups rely on cell libraries, memory generators, synthesis tools, and
simulators that are commercial and proprietary. They rely on the existence
of sophisticated fabs where the NDAs to gain access to their designs rules
are legally enforced.

I am only arguing for a definition of open where chips realistically could
be built using open hardware designs.

A couple of side points:
1. It doesn't cost $10K for a software compile. That is basically what a
chip fab is.
2. Some of the "open" hardware designs are being commercially sponsored now.
It will be interesting to see what license their sponsors permit.
